LISTEN: "Legally Speaking" with Michelle Suskauer

LISTEN:

Florida this week became the third state in less than 24 hours to put an inmate to death since a botched execution in April.

Longtime local defense attorney Michelle Suskauer tells us that incident involving a bad mix of drugs as part of a lethal injection caused other states to stop and take an assessment.

"There's always been a debate as to what constitutes 'cruel and unusual punishment.'  There's always a debate as to whether or not different states should be utilizing the death penalty, but what that did in Oklahoma was it really fired up the debate.  That's why there were so many states that had stopped."

She says these first three states have now set a precedent for the rest of the country.

"We're going to see more states that are going to start executing individuals, using lethal injection again, but there are going to be challenges by inmates.  And there have been challenges as to what the actual medications that are being used on them (are)."
